Is the 6th day creation under the same law as the 8th day creation?

Lucifer was first a Cheribum guarding the Mercy Seat, before Lucifer fell I assume that there was no evil so why was a Mercy Seat needed before Lucifer fell?

Ecclesiastes 12: 7 where it says then shall the dust return to the earth and the spirit to God, does this mean that "all" people go to be with the Lord until Jesus returns at the 7th Trump, or is only those who believed in Jesus? What happens to those that turned against Jesus and those who lived apart from him?
